Welcome to The Plug ("The Plug," "we," "us," or "our"). The Plug is a ride-hailing platform that connects passengers ("Customers," "you") with independent drivers ("Drivers") for transportation services. Our platform allows Drivers to submit bids for ride requests, and Customers to choose a Driver based on the bid amount and other factors.

By downloading, accessing, or using the The Plug mobile application (the "App") or our services (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App or Services.

1. Definitions

"App" means the The Plug mobile application available for iOS and Android devices.

"Customer" means a user who requests a ride through the App.

"Driver" means an independent user who provides transportation services through the App.

"Bid" means a price offer submitted by a Driver for a ride request placed by a Customer.

"Ride" means a transportation service from a pickup location to a drop-off location requested through the App.

2. Acceptance of Terms

By creating an account and using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App as a Driver, you also agree to the Driver-specific terms outlined herein.

3. Eligibility

You must be at least 18 years old to use the App. By registering, you confirm that you meet this age requirement and that the information you provide is accurate and complete.

4. Account Registration

To use the Services, you must register an account with a valid phone number. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. How The Plug Works

5.1 For Customers

When you request a ride, your request is broadcast to nearby Drivers. Drivers may submit bids with their proposed fare for your ride. You can review the bids, including the fare amount and Driver details, and choose to accept a bid from a Driver of your choice. Once you accept a bid, the selected Driver is assigned to your ride.

5.2 For Drivers

When you are online and available, you will receive ride requests from nearby Customers. You may submit a bid with your proposed fare for the ride. If the Customer accepts your bid, you are assigned to the ride and are expected to complete it.

5.3 Payment

Payment for rides is made directly between the Customer and the Driver, independent of the App. The Plug does not process, handle, or facilitate payments between Customers and Drivers unless an in-app payment method is explicitly selected. The Plug is not responsible for any payment disputes between Customers and Drivers.

6. Role of The Plug

The Plug is a technology platform that facilitates the connection between Customers and Drivers. The Plug is not a transportation company, and it does not employ or contract with Drivers. Drivers are independent third parties who use the App to offer their services. The Plug does not control the Driver's vehicle, conduct, or the quality of the transportation service provided.

7. Customer Responsibilities

• You agree to provide accurate pickup and drop-off locations when requesting a ride.
• You agree to be present at the pickup location at the agreed time.
• You agree to treat Drivers with respect and not engage in any abusive, threatening, or unlawful behavior.
• You are responsible for any damage you cause to the Driver's vehicle during a ride.
• You agree to pay the agreed fare directly to the Driver.
• You agree not to request rides for unlawful purposes or to transport illegal items.

8. Driver Responsibilities

• You must hold a valid driver's license and all required permits for the jurisdiction in which you operate.
• Your vehicle must be roadworthy, registered, and insured in accordance with applicable laws.
• You agree to provide safe and professional transportation services.
• You agree to complete rides that have been assigned to you. Canceling assigned rides may result in suspension from the platform.
• You agree to treat Customers with respect and not engage in any abusive, threatening, or discriminatory behavior.
• You are responsible for declaring and paying your own taxes. The Plug does not withhold taxes on your behalf.
• You are an independent contractor, not an employee of The Plug.

9. Document Verification

Drivers must submit required documents (driver's license, vehicle registration, insurance, etc.) for verification before being allowed to accept rides. The Plug reserves the right to suspend or terminate accounts that fail verification or whose documents expire.

10. Bidding System

• Drivers may submit bids for ride requests at their discretion.
• Bids are non-binding until accepted by a Customer.
• Once a Customer accepts a bid, the fare is fixed and cannot be renegotiated.
• Drivers should not submit bids they do not intend to honor.
• Customers are not obligated to accept the lowest bid and may choose based on any criteria.

11. Cancellations

Either party may cancel a ride before it has started. Repeated cancellations may result in account restrictions. If a Driver cancels after a bid has been accepted, the Customer's ride request will be re-broadcast to other nearby Drivers.

12. Prohibited Conduct

You agree not to:

• Use the App for any illegal or unauthorized purpose.
• Impersonate another person or entity.
• Manipulate the bidding system or submit fraudulent bids.
• Harass, abuse, or threaten other users.
• Share your account credentials with others.
• Attempt to circumvent the App's payment or rating systems.
• Use the App if you have been previously suspended or banned.

13. Ratings and Reviews

Both Customers and Drivers can rate each other after a ride is completed. Ratings help maintain quality on the platform. The Plug may suspend or terminate accounts with consistently low ratings.

14. Intellectual Property

The App, its design, logos, and content are the intellectual property of The Plug. You may not copy, modify, distribute, or reverse engineer the App without our written permission.

15. Disclaimer of Warranties

The App and Services are provided "as is" and "as available" without warranties of any kind, express or implied. The Plug does not guarantee that a Driver will be available, that a bid will be submitted, or that a ride will be completed. The Plug does not warrant the quality, safety, or timeliness of any transportation service provided by Drivers.

16. Limitation of Liability

To the fullest extent permitted by law, The Plug shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the App or Services. The Plug's total liability shall not exceed the amount you have paid to The Plug, if any, in the preceding twelve (12) months.

The Plug is not liable for the conduct of Drivers or Customers, including but not limited to accidents, injuries, property damage, or payment disputes. Transportation services are provided by independent Drivers, not by The Plug.

17. Indemnification

You agree to indemnify and hold harmless The Plug, its officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of another party.

18. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

19. Modifications to Terms

The Plug reserves the right to modify these Terms at any time. Updated Terms will be posted within the App. Continued use of the App after changes are made constitutes your acceptance of the new Terms.

20. Account Suspension and Termination

The Plug reserves the right to suspend or terminate your account at any time, with or without cause, including for violations of these Terms, fraudulent activity, or behavior that harms the platform or its users.

21. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Zimbabwe. Any disputes arising from these Terms shall be resolved in the courts of Zimbabwe.
